The jurist Janaína Paschoal, one of the impeachment request of the authors of President Dilma Rousseff said on Thursday (28) that senators should take into account, in the judgment of impairment, the investigation of the operation Lava jet, which clears embezzlement Petrobras. The committee reviews the charges against Dilma government in the impeachment process. The board will vote on a report recommending the establishment or closure of the case by the Senate. "There are people shooting video, talking to the people who have nothing Lava jet in the complaint. The common people send me email wanting to understand. The first pillar of our complaint is the Lava Jato, is Petrolão. The second pillar are pedaling. The third pillar are the decrees [to open additional credits without authorization from Congress], "said Janaina Paschoal.
"Well, following the work of Paulo Brossard [retired minister of the STF killed in 2015], including facts unrelated to the complaint in an impeachment process, which is legal and political, they can be taken into consideration by the Senate at the time of trial. The doctrine says it is in my report, but I'm not asking your excellencies to consider anything beyond what's in the complaint, nothing beyond what is in the complaint, even though Paulo Brossard give me backing for that, "added the lawyer.

Senator Vanessa Grazziotin (PC B-AM) disagreed Janaína Paschoal as to the extent of the complaint to be considered by senators. For Grazziotin, the judgment must be made up only of what is in the process sent by the House of Representatives: the "tax pedaling" and the six budget decrees published without the authorization of Congress.
"The letter sent by the House: the mayor announced the authorization given by the house, the proceedings were instituted for a crime committed by virtue of the provision of additional credits and over again, the Harvest Plan. Then she comes here, speaks of anything but those two issues, "explained Vanessa Grazziotin.

During testimony before the joint committee, Janaina Paschoal said that within the "pillars" of the complaint, has "plenty of crime" to justify the impeachment of President Dilma Rousseff. "Each of these pillars has plenty of crime, has responsibility to spare crime and has plenty of common crime," he said.
Or 'pastor' or 'holy mother'
Following, the lawyer said that is not "holy mother" or "pastor" referring to a speech made in São Paulo and won repercussion on the Internet. She said she was approached by journalists, including from other countries, who questioned if she practiced any religious activity. In the video, Janaina Paschoal makes an impassioned speech in favor of the impeachment of the president.
"I do not have the necessary lighting not to be a pastor or holy mother. My legal work would be worse if it were holy or pastor's mother because the state is secular, it's not been an atheist, is the state that makes all religions live together well, "he said.
The complainant also gushed, speaking in a choked voice on the Federal Constitution, which, she said, is "sacred book." "This [the Constitution] is the holy book that allows all the sacred books are respected and live together well. What I want is for the children, Brazilians believe it is worth fighting for this sacred book, "Janaina said.

See what they say the complaint and defense:

- Tax pedaling
Tax rides are delayed transfer of the Treasury to public banks for the payment of social benefits. The practice, according to the complaint, is a crime of responsibility because it represents a loan from the banks to the government, which is prohibited by law.

The defense says are not credit operation and that the president did not sign any of the transactions mentioned in the complaint.

- Additional credit
The government issued decrees releasing additional funds without the authorization of Congress. According to the complaint, Dilma could not have released the credits because it was known that the country would not meet the fiscal target.

The government claims that the issue of the decrees without legislative approval is required by law and that the parliament itself admits increase the budget authority to regulate the supply of public services.

- Legitimacy of impeachment
The complaint says the process should not be seen as a "blow" as is foreseen in the Constitution. The defense claims that there are no grounds to support the impeachment.

lava Jato
- The complaint cites Operation Lava Jet and the alleged involvement of former President Luiz Inacio Lula da Silva, next to Dilma, the Petrobras corruption scheme. The piece came to include the plea bargaining of the Amaral Delcídio Senator (no party-MS), who said that Dilma acted to interfere with the progress of Lava Jato. During the proceedings in the House, however, MEPs decided not to consider it snitching.
